Regardless of whether it is art or vandalism the property owner can choose to paint over it, modify it or whatever. The point I was making (as you well know) is that whether something is art or vandalism is not a matter of law, it is a matter of perception. Feels like society's perception of what Banksy does is "art", not vandalism as you would have it. Try to think about it outside the strictures of the law.

The vandalism has been vandalised. Oh the irony.
Anyone remember the "artists" who put clean sheets on Tracy Emin's "Bed" artwork, tidied it up and hoovered

They then claimed it was a legitimate piece of Performance art

The law would still have been broken as a matter of technicality. As a matter of reality no action would be taken if the owner didn't report it.

Chuck a gold brick through my front window it'd still be criminal damage, but I probably would let it slide.
