Does it really count as spotting a fake if you guess from the situation rather than the quality of the image though?
The definition of Fraud is interesting, the loss/gain doesn't have to be financial:
Does that mean that someone could put an end to the AI industry by suing one of the big companies for fraud? I don't think anyone would be able to get away with overtly marketing plates for printing £50 notes, even if they said they were only intended for printing studio props. (I remember the episode of That's Life with a souvenir shop that had been threatened with prosecution for selling pound note tea towels.)

I think so, knowing the context behind an image is as important as visually identying it as AI.
