Help! Distance selling - right to cancel?

Bought a garden parasol on 3rd May on t'internet and received a prompt email confirmation with the order number but no indication of delivery date.

Yesterday, still no news so I phoned and was told they would check with their supplier and call back in 5 mins. They didn't, so this morning, c. 9.30, I called and got someone a bit more senior who said he would check with the supplier and call back shortly. Still nothing.

  • you can get a refund if items aren’t delivered on the agreed delivery date
If no delivery date is given, you can get a refund if items aren’t delivered within 30 days of placing your order.


From the suppliers site though:
FAQ: How long will my item take to arrive?
This depends on which item it is, whether or not we have it in stock and where you live. Each product on our website has approximate lead times displayed next to its photo - we aim to deliver most beds and mattresses the next day.
My shopping basket showed: " .. Parasol .. 5-7 Working Days""

Can I cancel now or must I wait 30 days? I shall be ringing them back later this afternoon.

Why do you want to cancel the order? You are only on the 3rd working day today so they are still well within the delivery time as they have until the 15th. If the item hasn't been sent yet I would think the place you ordered it will cancel it and give you a full refund or cancel the payment if it hasn't been taken.

I don't want to cancel the order really, I just need to know the item has been sent or when it'll be sent or even that it will be sent! So far they have failed to answer any of those questions and having said they would call me back, twice failed to do so.

Although I do order a fair bit of stuff online it's very rare IME for sellers to fail in this way. There is also an issue with their website as when I try to track my order, it says it doesn't exist. The money was taken from my account on the 3rd May.

You can cancel the order anytime before delivery and up to 7 days after it has been delivered under distance selling.

Still no refund via Paypal despite email and a couple of phone calls. Will be raising Paypal dispute if not there by Monday.
