I'm not at all confident. I suspect the op will get nowhere . I'm just telling it bow it is. The law does not allow for buck passing when running a site. Legal responsibility is defined. Its why firms pay so much in public liability insurance.
if you chase the lorry for picking up mud you may as well chase the local authority for laying a road surface that allows mud to stick, or god for creating mud...or the human race for occupying this muddy little planet. If we are going down that route then I'm happy to pay my share...
