I think the point I was trying to make is that without an adequete police force the investigation doesnt get done to the best extent, evidence and witnesses become problematic.

I agree the CPS do decide whether they charge or not. There are clearly problems with that service and the sentancing guidelines Judges and Magistrates use.

I am sorry but 4 years (out in 2?) is a joke. I am sure they would have got longer than that if they had robbed a bank FFS. GBH??? This attempted manslaughter at the very least surly? The assault I suffered (Cut nose, bruising to face and body and broken shin was classed as GBH with intent. The law in this country is insane. I am strongly moving towards a belief that the punishment should fit the crime.

TBH, the society as it is, is why I don't go for a night blast down the canal paths and Trans Pennine where I live - meet a bunch of idiots... I've no chance.

At least this week, the guy that stabbed a burglar is not being prosecuted ! Might help the next time some idiot attempts to get in my garage again, and get's d-locked !

4 years is a disgraceful sentence - I know that they will also not serve anywhere near that time.

If that was my relative and they got that sentence it would make the situation even worse - the real 'justice' would happen when they got out, even at the expense of spending a very long time inside myself.

I'm afraid you're incorrect.

  • Police investigate
  • CPS decide whether to prosecute on the basis of the evidential and public interest tests
  • If there is a guilty plea or the person is found guilty following a trial, the judge/magistrate sentences in accordance with the law and the Sentencing Council guidelines
We do not have 'plea bargaining' in England and Wales. Sentences are decided by the judge - not by the barristers.

In particular circumstances barristers may recommend leniency to the judge - but they would certainly not suggest a particular sentence. If they did, they'd get a judicial kicking...

Ah I stand corrected - It was a guilty plea and nature of crime that was entered in the case of my assault. (Actually went up from GBH without to GBH with intent) The sentencing was carried out by a judge. The jury were never called.

lengthy prison sentences. = 4 Years each? ... maybe 140 years each I might say "yeah a little bit long (with a smile)) ... but 4 years and that's classed as lengthy? ... the law is a complete joke, you'll receive 10 years for robbing a few grand from your employer ... life is so cheap in this country

Yes its a ****ing joke, the guy was left with permanent, life changing injuries and they got that. Disgraceful but sadly I'm neither shocked nor surprised.

Just make sure the force you use is appropriate to the amount you fear for your life at the time and all should be well...

To be fair, the guy that homeowner stabbed was wielding a machete at the time, IIRC. You couldn't just creep up on an unarmed burglar and stick a carving knife in their back, mores the pity
