If you were riding your bike accross a crossing that you really shouldn't have been you will probably find that you will still have a claim but it will be contributory negligence. You still shouldn't have been hit by a car but you shouldn't have been on the crossing so they may use this against you.

In my case they said that they were indicating left and I shouldnt' have gone inside them - the highway code says not to do this. I swear blind that they weren't indicating left and she just flung the door open without looking and this is why I had 15% of my claim cut out. I still had a claim though.

Car came across my bow, took me out in January. Bike destroyed, severely separated shoulder. Bear in mind this was a driver from a large company in his company motor. Sorted it out without solicitor to replace my bike in the 3 figure range. Company obliged.

Then realised that my shoulder was completely shot. Approached solicitor.

Solicitor took the case to the company. Company admitted liability. 4 figure sum paid into my account last month. 6-7 months turnaround. No fighting.

Mind you, i do have a crippling addiction to codeine-based painkillers now and a permanently weak shoulder but hey-ho.

I would recommend Digby Brown solicitors, although i think they may only be available in Scotland

dhd.evans you haven't settled despite the pain etc ? :ohmy:

Took 3.5 years for me, mine was into 5 figures but £3k physio bill :wacko: and an op two years after the accident (that was a fight with the NHS). Almost 4 years now and it's about 90% and I'm in the gym working on the 10%. Pain wise - no painkillers now, occasional twinges.

OP - Your solicitor is the one who should be advising you on likely sums you should get for your injuries. This is why you instructed them, yes? Ring them up and find out.

I was knocked down over 18 months ago. Several visits to specialist "quacks" and lots of physio to my shoulder and arm. Need an operation to relieve trapped nerves as it aches quite a bit. Still not a single penny from the other side, not even re-imbursement of taxi fare to get me and my bike home from the hospital which cost about £20 and all the pain killers. As fossy has said it is a long hard struggle. Better not to get injured in the first place. When I was knocked down 12 years ago I got just over £20k as my injuries were a little more serious, but again it was a long hard and often demoralising fight which took a lot of energy. Was so glad when it was finally over after just over 3 years.
 
Best advice, talk to a lawyer. My wife practices law, and I can tell you to settle or sign NOTHING until you have spoken to a lawyer first. Until you are 100% health wise, you never settle. And they are responsible for your bike as well.

Only issue may be if you were riding your bike across the walk and not walking it.
