We purchased some furniture items (approx. £250) from BHS via the internet for home delivery and paid via credit card.

The items were tracked on the internet, delivered by Hermes couriers. The tracker says the items were delivered and signed for on Thursday, but neither me or my wife were at home, and no card was put through the door. We have spoken to both our beighbours to see if they have it, they don't.

So where do we stand? Hermes say they delivered it and have a signature? We are £250 down and no items? Sometimes stuff gets left inside our porch, so it's possible that it has been stolen?

The theft isn't an issue. The fact is that you didn't sign for the goods. Hermes' subcontractor needs his/her collar felt.

First thing to do is ask to see the signature. If it's a squiggle and not recognisable as yours or your wife's then I'd take it up with BHS as using a sloppy delivery service.

I wouldn't worry too much though as it should all be covered by your credit card.

Ask for proof of delivery.
We get the same problems at work every week and they haven't actually delivered anything and the items will be sitting in a depo somewhere.

Tell BHS you are not happy and insist they investigate further.
I had a similar 'non delivery but signed for by someone unknown' experience within the past month. After a phone call to the sender my package was "found" by the courier in a greenhouse behind an unoccupied house and duly delivered to my door.

Credit card payment-insured! Get on to the credit card people and tell them, they will carry a lot more influence with BHS especially when they tell BHS they won't be paid for an undelivered item (s). Sometimes things then re-appear.

I would approach BHS first. Your contract is with them. You've paid them, they haven't delivered (by whatever means they chose to employ). It's their responsibility to sort this out. Only approach your CC company if BHS are unresponsive. I'd contact BHS. Then again, if not happy, stressing that you will contact your cc company next. If that doesn't work, go to VISA or whoever.
