according to my employment law specialist missus..

If you have an equal opportunities policy, it would say that all vacancies should be advertised internally. However it's not against the law not to.

There is generally no obligation to advertise a job externally, unless it is a condition of funding or something (as the person responsible for compliance in my past three posts, I've been ignored on this many times, much to my chagrin).

Are there any regulations in relation to a small firm creating a post and offering it to someone without advertising it or giving others the opportunity to apply?

is it a post thats been created to move someone into?

think it can be written off as restructuring or re-defining someone's roll and that way doesn't come into the realm of a vacant post

thats kind of how my dad got his current job, pointed out someone was needed to do a certain specialist role and got asked how much for him to do it.
