Got hit by a car from behind, bike ok, sore back, advice needed please

So I was coming up to a round about and stopped for a car on the roundabout, a girl hits me from behind, the bike gets pushed away and the car hits me up into the air breaking the wing mirror and I fall on my back.

I have her reg name address and number. Will report it to the police tomorrow (went to the hospital and just got back) is there anything in particular I need to say? Never delt with the police before. I saw the statement template but I'm not sure all that is needed? I just want my mudguards replaced as the rest of the bike looks fine, will check the frame properly tomorrow of course, think I will be sore tomorrow :-(

You should have a medical checkup. You may have injuries now that only become obvious at some point in the future.

And no I'm not an ambulance chaser.

Visit your GP. Have your bike checked out by a good bike shop. Take it easy.

You are entitled to compensation, to be put in the position you were prior to the other party crashing into you, this is your lawful right.

You will probably need a solicitor as the police won't give you the driver's details, insurance etc, citing Data Protection which is what Cambs Police did to me, they refused point blank to tell me who the driver's insurance company was despite me being injured. It turns out they do this so they can charge a lawyer £80 for requesting this. Sorry but B*"&"£=s!

You can make a formal request for the police to supply the insurance details of the only driver involved & those for the vehicle. They have a duty, by law, to provide such information.

Follow the advice given at the hospital & don't attempt to fully asses the damage yourself. Either to yourself or the bike. Penny bet says your neck will be sore within the next 48 hours, if not already sore.

Get down on paper your version of what happenned, as soon as possible. It doesn't need to be 100% accurate on the spelling or your choice of wording, so long as you can put down in full what happenned at a later date from it. If you think you may be missing anything or your wording may not be correct, have a look at the MIB site & see the uninsured/untraceble driver forms. A lot of detail is asked for on these forms & they may make you realise you've missed something out/could word things better.

Thanks for the advice guys, i want to the hospital after debating it for 20 minutes post-crash. All OK, got some pain medication, no X-Ray. Said i was very lucky!

That is unlucky, I saw your other thread you wanted to test a road bike this week-end. I guess you have to postpone this? Get well soon!

Yes unfortunately! suppose it's lucky i didn't have the new bike... Carbon frame and all that. driver stopped and assisted/offered to call ambulance/lift home etc. Maybe i'm too proud/stubborn to accept help lol. calling the police to report it soon just jotting down what happened. Back is better today/ meds are very good!

She said she was really busy but i could be put on hold for around 20 minutes if i really want to report it so i didn't bother...

However, my mudgard was broken and i don't see why i should pay for a new one, but i didn't get the other persons insurance :/ what can/should i do?

Sounds like you've been fobbed off by an un-caring staffer. Get down the station and report it.

When you are able to, get your bike down to your LBS to assess the damage to your bike. You mention having a broken mudguard; if this has broken, there may be damage to the bike that you might not notice. Play it safe.
Agree with going to the station to report. It is a RTA, so I think im right in saying that it should be reported. Someone was injured, you were! Stop being nice about it and get it reported properly! ^_^

Certainly call in to the station. In my case it was just logged and I got a log number. Wasn't needed in the end as the driver fessed up - legal/injuries took 3.5 years to settle though. :laugh:

You only feel fine being on the meds - stop taking them and you'll feel it.

Action:-

1 Call into Police Station
2 Call Driver for Insurance
3 Call a Solicitor
4 Book a GP appointment in a couple of days - see how you are.
5 Write down pain symptoms, photo bruises and damage to bike, however light. If you've even scuffed up your pedals you are entitled to get new.
6 Off to LBS for a once over and a damage quote. Don't forget any damaged clothing/helmet/bags.
7 Receipts - Keep any receipts for purchases, travel, medication (pain killers).
8 Save the accident notes to your PC / keep in a safe place and date it. I referred to my notes on many occasions to see when symptoms started - it's not easy remembering 3 years ago when you are infront of a medical consultant. Do this and it helps.

IMO staffer who doesn't know her job or the law - you've been fobbed off. You were injured, it HAS to be reported. If you get the same response, ask to speak to their boss.

Glad to hear that you are ok, and hope you quickly get the compensation you need for your bike!

I'm confused as to when to report an incident to the police. I always understood that, if there were injury or injuries, the police had to be contacted and all parties were required by law, to stay at the scene. When did it become the responsibility of those involved to assess what is a serious injury and what is not?
Several have said they "went to A&E later that evening" or "reported the incident a day or two after it happened".
If I was involved in any collision where anyone was injured, I would rather have the police attend for everyone's protection, including mine. So what is the law/advice for when to request police attend the scene? Is it only if an ambulance is called?
