I am no angel, but my father in law has just walked out with no notice and gone back to South Africa, left his wife, daughter and grandson in a house in massive negative equity due to second mortgage and secured loan, he also hasnt paid a utility bill in almost a year, has been hiding everything from them.

The mother in law is now left with around 35k debt which every account are in arrears! a couple of bits like a 2k credit card and a 3k loan are his name, but the rest is joint names...

He left his old Mercedes E220 on my driveway and cheeky zark just text me asking me to sell it and send him the money!!! am sooooo tempted to put it on ebay for 99p buy it now!!:biggrin:

I'd be more tempted to sell it and give the money to his wife.

sell it and give the money to his wife. He's unlikely to step back in the country to get the money back, as he is going to have debtors after him. Just sell the car and tell him you used it to pay off his debts but give the money to her

And tell her to see a debt agency. There is a charity called CAP (Christians Against Poverty... but the charity deals with non-religious people and they are recommended by the banks) that could help. If you need their number i can get it for you. She doesn't have to deal with this on her own and it's important she seeks help immediately to stop her falling into despair and depression.

o yes, one more thing, if she were to be able to afford the mortgage on her own (and is not in arrears) even if she went bankrupt they wouldn't take a house that was in negative equity as this would only put more debt in her name (i know this as FACT) so she would be able to keep it. There may be problems if he is behind with the mortgage tho, but as long as he isn't and its in negative equity, the Receivers won't touch it.

Just thought, you can't sell the car without his signature on the V5.


This is the problem! and having already been cautioned for "Fraud" as a teenager (I swapped tax discs from my old car to my new one while the docs came through in the post) I dont really want to copy his squiggle!

Plan B is.... as it has no road tax any more, I thought a cheeky roll out onto the road and an anonymous tip off should do the trick!! Dont they crush the cars now? :whistle: :whistle:

Send him the V5 for his signature, then when you have it back sell the motor and do the 'right thing' with the proceeds.

It is quite straightforward. Whether you actually send him the money is a moot point, but however it is sold it will need the document signing. I presume you have an address. Send him the V5, get it signed before the sale and then you can decide what you would do with the money once you have it. But, before you take a position on this one, I would make a double check that the 'problem debts' are actually his not the wife. Perhaps he left because she was the one with the money issues. Only a thought, as things are rarely as black and white as they first appear.

I know what you are saying, ironically she is actually an accounts clerk! ha ha but yes its him who has the money issues.

Yes, I do plan to have her be there and do any of the signing reciepts etc, I am just there to haggle over price and show the car as its on my driveway.
