Laptop power indicator playing up

My lap top's power indicator seems to be playing up, it's running out of juice and switching off whilst still showing about 40% battery power remaining.
Any ideas?

Possibly the batteries are on the way out.

I had this with an iPhone. Power would show around 30% and then shut down on the next call to come in

Orange thought it was a battery issue and sent a new phone.
