HSE?

Strictly on the basis of

- no apparent assessment of risks, that reflects professional standards, legal requirements, and practice required by the HC.

- no adequate incident reporting and recording.

- no adequate structures to deal with incidents.

His actual driving is a matter for police ... but that's kinda late. But Griffitths have a problem if they don't have assessment/reporting/response structures in place? Trying to find the reference.

Unfortunately, due to policy decisions about expertise, not to mention that HSE are not equipped to deal with RTA's, HSE do not get involved in road transport issues. Investigating RTA has always been a police matter, except where dangerous occurences involving specific loads (overturning, loss of containment etc) are concerned where both are potentially involved. If the police had a dossier of concerns then HSE might, might, look at safety management issues. Severe funding cuts means that HSE are hard pressed to investigate the usual industrial accidents, so little chance. Been out of the loop for a while, but that is my recollection of the state of play.

Oh and the Press might well be interested, especially if you were to call MJ again and happen to record the call.....in the public's best interest I would have thought.....

Its only legal to record a phone call without consent for your own personal use. If you make the recording available to a third party without the consent of the other party to the call, you are breaking the law.

If you inform him that the call is being recorded by you. it seems that you can pass it onto a third party.

I would suggest outing a company who does not give a hoot for public safety is in the publics interest....

Well if he informs the person answering the call that the call is being recorded, that person has the choice of answering the points raised or simply hanging up.

Would it not be better to set up another YouTube name and only ever have one video on it; the one you are passing to the company to view. Delete it after they have seen it then upload it to your own channel at a later date for the education of everyone.

That's a good idea. I may consider doing that for the most serious examples in any case.

If you record a telephone conversation then there is a beep every now and then played to the other party.
That is if you digitally record it with your phone, if you use a method of external recording then you don't obviously get that that beep.

I think Gaz Magntom BSRU have all had this retort, even from the police, about being out to get motorist and purposefully causing close passes etc etc. They are obviously searching through the other uploads looking for excuses to get back at you.

These appalling videos of uncaring arrogant ignorant pieces of shoot taking liberties with our lives need to be marketed a little better. The uTube channel they are viewed on should contain lots of happy sweet cycling moments, Mammy, Daddy, couple of children cycling through the countryside on a blue sky day with butterfly's fluttering by and skylarks singing. Get your self a pretty user name like LavenderBlue. Make their shitty driving stand out for what it really is.

I have learnt my lesson, next time I report something to the police it will be on a new channel dedicated to the one incident with no reference to my main channel.

Thanks everyone for the replies. I did try reporting to the HSE through their online form, but unfortunately, you have to choose the incident type from a list that doesn't have anything to match this. The points about recording telephone conversations are interesting but I don't think is a realistic way forward to be honest.

Whilst it riles, I think the advice to let this one go is probably right. This seems like a bit of a cowboy company that does need to be dealt with, but I don't think I'll be able to achieve that through this case.

On a brighter note, I just received through my blog a personal message from a driver who featured in another of my videos, apologizing profusely for "acting like a dick". At the moment, he doesn't want his boss to know he wrote, but I may publish more details later.

On a brighter note, I just received through my blog a personal message from a driver who featured in another of my videos, apologizing profusely for "acting like a dick". At the moment, he doesn't want his boss to know he wrote, but I may publish more details later.

I'd say props to the driver, who, obviously wouldn't of given it another thought had he not seen your vid, but at least he had the balls to apologise for his wrong doing (albeit so his boss doesn't find out), but hopefully in the future he will realise that a lot of cyclists nowadays wear head cams and will drive a little safer....I'd say good job, and move on

Well I do think it was a genuine apology. he only knew about ther video because I'd already reported it to thew company. He just didn't want his boss to know he'd contacted me. So a good result as you say. :-)
