I just wondered if magistrates have to have any legal training or come up through the ranks of the legal system to preside over cases in the magistrates court?

Cheers,
Shaun

They are not legal professionals but do receive training.

In court, they will defer to the clerk of the court for advice on legal protocol.

Magistracy are lay people doing a civic duty for expenses only. There also used to be stipendiary (salaried) magistrates sitting in the main cities who were lawyers but these are now known as District Judges.

I know one who is a total nutter, does it to counter a feeling of inadequacy, and should not be let near decisions concerning people' lives. Sad, but true.

Hey, I am currently going through the process of becoming a magistrate here where I live. It's a very interesting, but time-consuming, process.
