It's a glitch in the planning, and one that Boris was trying to overcome a couple of years ago in London, though I'm not sure what the outcome of that was. And that's why feeder lanes were introduced.
New ASLs should all be marked up with feeder lanes, but there are still many older ones which aren't. And they're normally on the pavement side, which isn't helpful if you're not riding in the gutter approaching the junction. In Birmingham at least I've been told that the authorities take the right approach and wouldn't punish cyclists for crossing the line.

Only in the UK could we create a 'safe' area for cyclists and only allow them in to that 'safe' area if they contravene the law.
I can't imagine a cop would ever try to prosecute a cyclist under such circumstances and even if they did, I can't see it getting very far, but you are correct, technically the offence would be committed.
