Wow guys this has escalated quickly! I raised a Paypal dispute to get things moving - so what's the conclusion here regarding return postage? If Paypal refund my cash I assume I'll need to pay for it to be sent back?

Also, I think the seller has a registered business for selling bikes - does this change things? (re. the long argument above)

Yes & no. It can come down to how the one you bought was advertised. He may have been selling it as a one-off, seperate from the business or maybe through his business.
Even second hand car salesmen will sell there own cars privately & not as part of their business.

Dan you are wrong.. Trade description does not apply. This is a private sale. The description is unfortunately a matter of interpretation.

Out of all the posts its only you giving the wrong information. Private sales are buyer beware.
Yup, very true.

Much like selling a car, you have far more rights when buying from a company than an individual, if a company says xyz then you have a right to expect that and have recourse even after the sale, if an individual says xyz you have to check it before the deal is done.

Saying that, I'd try and reason with the guy and get some cash back so both sides are a little happier.

I think that is only fair TDM, interpretation of "condition" differs, you took a chance buying unseen and I think you should accept an element of responsibility and funding it's return seems about fair to me.
