It is really very silly, but becoming a heated argument

Iceland (the frozen food retailer) has a European trademark on the word “Iceland”, and has attempted to legally stop Iceland (the Country) labelling products withe the Country's name, "product of Iceland" or similar

Iceland (Founded before the Supermarket) is now challenging


There was also the case of the aggressive branding of the Olympics were worse like "Olympic", the date "2012" and other were "trademarked" and the fact that you can no longer trade foodstuffs under a name starting with Mc or Mac, as these are "owned" by McDonalds



Is it time that these companies were stopped from this "buying up" of names and being allowed to aggressively stop others using often traditional names, often in place before the big companies

I don't understand how this is a dispute given that honest "geographic origin" descriptions don't infringe trademarks - see (2)(b) in http://www.legislation.gov.uk/ukpga/1994/26/section/11

Yes.

There should at very least be a case-by-case requirement for these companies to prove "passing off", or that there is genuine confusion among consumers, rather than a blanket ban.

The Iceland one is especially unjust.

Been out for Christmas drinks? I can't immediately think of any other reason why you'd get the :hungry: and xx( the wrong way round like that...
