My case with the B&T driver, the company got several hundred e-mails regarding the incident. It came up in court as a question but it was easy to blow over.

I don't know the nature of the emails sent to B&T but the police contacted me the day after uploading to say WNW were getting threatening phone calls and emails. I wonder whether that or the media interest would have had an effect on any prosecution.

Why does it matter what other people are doing? Even if prejudgement is happening on YT, the people who watch that video are not the decision makers. The facts of what has happened remain the same people on YT cannot influence that.
The only possible interference that I can imagine the police coming up with is that other peoples views of changed the actual victims views. But I dont see how they could prove that. And I dont understand how evidence which has been online for everyone to see is any different to thousands of people actually being at the scene where something happened.

If everyone on my street looked out of their window and saw someone get stabbed, is that exactly the same as watching a video of it online? YES!

Emails and general abuse following internet publicity of an incident is merely mitigation, it does not impact on the viability of a prosecution.

Assuming a conviction, the defendant's lawyer can say at sentence: "My client has already been punished for this to a degree by public approbation expressed online."

In other words, the lawyer can invite the judge to mitigate - reduce - the appropriate penalty.

I have had some good experiences with Hampshire Police and Video.

They have always taken it seriously and I have been successful in that action has been taken over the driving

I guess it's a bit of a lottery, as my dealing with Hampshire Five-O have been less than sparkling. I assume that, unlike the metropolitan forces, they've not seen the same upsurge in cycling numbers so they still have a car-centric view of the world.

Yep, I thought that too. Its a crafty way for the suspect to get away with less.

I was involved in an incident in the New Year with a taxi driver. The inspector dealing with it knew that the video was online because the council had contacted them about it. After the incident was dealt with, he told me the outcome and said that he would like me to take my video down. I told the inspector I would so but only because of the polices good work in this situation.
Although the other persons video is still online incriminating themselves, my video showed hardly anything.

However its tosh - the CPS know how to handle this and have counters for it.

In my two unfortunate experiences of the CPS, they wouldn't know how to handle a tea-bag, let alone a defence ploy ...
