Unfortunately bullies tend to walk all over you if they get a sniff of an idea that you're a soft touch. Sometimes you just have to stand up to them and say no.

I would say to him very clearly that you understand he had the right to repair his roof but he'd better understand that if he mucks up yours in the process he'll be fixing it or getting sued.

Have you got buildings insurance? I woudl say contact them. Any damage that he causes from negligence to your property would damage you building. You would claim this against your insurance and in turn they would claim the monies back from his insurers if they can prove negligence.

You may also find that you have a legal helpline with home or buildings insurance.

Don't worry if they do the damage you can claim, but make a notification to your insurers now.

This is a very good point. Mrs R was able to get free legal advice on her job contract, from our buildings & contents insurance.

The gist seems to be that it's far better to find an amicable solution if at all possible!

If this clearly unpleasant neighbour is really going ahead, would the work really be a problem if done properly or could it solve the issue that has been a problem for so long?

My British neighbours in France are slightly weird. When we moved in they came over very aggressive about who owned what land (their garden is huge compared to ours anyway!) and in fact their gutters discharged against our barn wall. I knew that it would be useless to confront them and escalate bad relations and have built a waterproofed concrete spillway to deal with the water. What's more I was later able to discharge our own gutters into the channel without them being able to protest in the slightest. We get along ok these days.

My company installs roofs.

1.Take good pics, many, from far and near, from all angles, do it now. Again, as soon as the job is completed.

2. Write to your neighbour (keep copy) politely insisting that nothing is to be installed on your side without your written permission. No overlapped felt, nothing.

3. If he changes the drainage and you have future problems, he has introduced that problem, your insurers will be on to him to remedy and you will have all the relevant pics from before and after won't you?:smile:

As well as planning officer [who probably won't want to know if it's maintenance] ring your Local Building Inspector at your council [ask for the Building Inspector who deals with your area and tell him your problem- I'd hope he'd offer to come out to check the work if you explain.

I'm made up with all this good advice! Thanks everyone. Yes, I had thought about the insurance (we do have buildings) and I am going to ring them in a bit. At the moment I am charging the camera ready for some decent pics. I may post some tomorrow so anyone with roofing knowledge can see what I'm talking about!

Archie beat me to it, the council buildings inspector is your guy. Not only will he know exactly what your neighbour is entitled to do, but if there is a problem the dispute will be between the council and wotsit for brains.

What, even when it's 2 private properties? He is repairing his own side. Anyway, got pics so tomorrow the OH my dad will be watching carefully. Informed the insurance too.

I'm waiting now for him to ask me to move the car off our drive ready for tomorrow. Oh dear ... can't remember where the keys are and I commute on bike anyway. :wahhey:

Yep, that's what the council inspector is for, to ensure that any works are carried out to regulations, which will include effects on adjoining properties.
