If the kid was 3 years old I would understand it. A 9 year old who had been "heartbroken" just a year before by the same thing should know a lot better.
We're talking about a kid leaving his bike in the garden while he goes for a piss. If he'd left it overnight or something I could understand the argument that he wasn't taking adequate care - but he didn't. He left it for a few minutes. Surely we should all expect to be able to do that?
