My bike was totalled by a car a few years ago and CTC solicitors handled everything with aplomb. Can't praise them enough. Full bike costs, clothing, medicines, physio bills and personal injury claim all recovered. However, I had a second bike to use till the money came through. If you need the money up front, you need to claim on your insurance, pay the excess, take the hike on your premiums (loss of no-claims discounts etc) until the claim is sorted, then the insurance company will refund your excess and additional premiums paid and adjust your policy.

Do get some proper legal advice . The CTC sounds like a plan .

Technically you haven`t incurred a loss until you buy a replacement bike ... what about a written quote for a comparable bike.

Your own insurers certainly don`t need to wait for the CPS to pay out.

Your injury claim will need to be directed to the drivers insurers .

If the third party insurers are resisting paying out the question you ask is
" on what grounds ? "... ie what version of events is your client giving that places me at fault ? The thing is the driver quite often ISN`T giving any such version ... they just don`t want to pay out .

Anyway a decent solicitor will know all this .


Oh and then change your own insurer ... most are not this awkward any more.

Sorry, I should have mentioned that I'm with Russell Jones & Walker via CTC (I'd put it in the original post in the piccies forum, just couldn't be arsed re-typing it :wacko:). Their guy is on his holidays at the moment but from what you've all said then I shouldn't have too much to worry about once I've seen him, so thanks, thats made me much happier. :smile:

I can wait for a new bike, I'm not expecting to be back out on the road until the end of August/early Sept & I have a winter bike which will keep me going once my shoulder is ok.
