Strictly speaking, no, we shouldn't. But really? It's only the internet, and this is only a forum used by a small percentage of people who take part in a minority sport. I doubt if any speculation on here is going to sway the verdict of a court. Anyway I did try to choose my words carefully, i.e. "looks like" - which it does. The only other explanation from the evidence available to us (the photo) is that it was a head-on collision with the cyclist on the wrong side of the road. I will speculate that that is unlikely.
