This is selective reductionism - like saying the cases are different because one was in Dorset, the other in Cornwall.

The mitigating circumstances for Mr Hall are surely that he was avoiding a collision on the road - the fact (or otherwise, depending whether you you believe Mr Hall Snr. or otherwise) that seems to be missing from the reportage.
