Got a link to a pic? The fact that he said he had to swerve around pedestrians which led him to swerve into other pedestrians makes it sound like an ordinary shared path but a pic would help.
As a regular reader of NYC Bike snob (This was his take on things, written before the victim had succumbed to her injuries) cycle lanes in NYC appear to basically be defacto shared use lanes because pedestrians (and taxis, and vans, and cars, and lorries etc. etc. etc.) wander in to them with some regularity. The existence of pedestrians in the lane shouldn't be used to presume this was intended as a shared use area. The biggest question here at the moment seems to be who had the red on the crossing. Also it's probably worth remembering (while I'm not saying the cyclist isn't a prime nobber who deserves a lot more than he is likely to actually get) that the rights of pedestrians in the USA are not the same as the rights in the UK.

Opinion varies.....
In the UK, Sustrans suggests 12 mph, The Dft says that at 18 mph you should be on the road, Bournemouth has a 10 mph speed limit on certain paths

According to the guy they interviewed he'd seen the cyclist doing at least 35mph on an incline.

Meanwhile, one Upper East Side retiree tells the Post that Marshall is a maniac who almost ran him over back in June. "I’m telling you, this guy was booking like you couldn’t believe,” Jim Kelly tells the Post. “He kept yelling really loud ‘Get out of the way!’ It was like, ‘Get out of the way or you’re going to get killed.' I had to jump backwards. He missed me by like two inches. You could see the arrogance on this guy. He must have been doing 35 miles per hour, on an incline! I’ve never seen someone go that fast in my life."

Nothing like an eyewitness account for a bit of exaggeration.

Shared use doesn't work, whether there are painted lines or not, pedestrians wandering all over the place mean that its impossible to go at much more than walking pace

We have shared cycle paths in Denmark. We share them with pedestrians and mopeds. It does work and it works well. At times you have to go at walking pace. I cannot remember reading about an accident on a cycle path involving a bike and a Ped or moped in the 12 years I have been here.

You just have to accept that the path does not belong only to you.
