My solicitor phoned me this afternoon(They always phone when i'm out riding :scratch:)to tell me the insurers of the fellow that hit me have made an offer they think is acceptable. They've offered just over £6000,so with the solicitor taking 25% i'll end up with just over £4500. Not bad, it took less than a year and i think it's a fair amount for the bike, a month off work and my physio fees etc. I'm just glad the idiot hit me near to a cctv and about 10 witnesses.

what you have to consider is 1 it covers all your expenses and 2 you have no long term medical issues because of this even if its a small nagging paint that will not go away in a couple of year will it get worse ect. I hope you are fine and back to being well and if your happy with the amount then everything is all good :smile:

Thanks.:okay: The only long term injury is my scarred knee, but to be honest the incident has affected my confidence therefore my hobby. I haven't ridden above 35mph since being hit and even then that's very rare. I also hesitate when cars approach waiting to turn right, so physically i'm ok but psychologically not quite the same as i was before being hit.

I'm sure when I got hit, I received everything I'd claimed for, with solicitor costs just added onto it.

Have you had an independent medical assessment of your injuries with a long term prognosis and an assessment for quantum of damages? If you have, and your solicitors agree that the offer is in line with the prognosis and quantum assessment, then take it.

If you haven't, then change your solicitors...


I had an independent medical last June. The doctor was a fellow cyclist so i suppose he'd have sent in a favourable report.
 
This, really important. I got hit by a car when I was younger and not well informed in the ways of the world. I should have got a proper medical report as my hip still gives me issues 30 years later!

The law has changed. The solicitor recovers base costs from the opponent. But under no-win-no-fee they can recover a "success fee" limited to 25% of your damages from you. Previously, this was recoverable from the opponent too. The success fee is an uplift on standard costs of up to 100%. This element should be negotiable depending upon how fiercely fought liability is. If liability is admitted or very clear, the success fee should be negotiable downwards by the client. Many accident victims won't know this and will sign up to 100% success fees without questioning them.

So imagine a claim for lifetime care costs - carefully calculated with nursing and housing costs - then up to 25% is taken in legal fees... but hey, the insurance companies will reduce everyone's premiums so that is OK ?

I'm sure it won't lead to reduced premiums, simply inflated claims as people add on "extra" expenses to compensate for the amount the solicitor takes.

Enjoy your compensation, I'm glad it's all worked out OK for you in the end. it's wonderful weather to be trialling a new bike!

What where your injuries? Am only asking as my wife was knocked of here bike a few weeks back. The insurance company offered a payment for the bike, But the injury payment will be paid at a later date.
