The speed bumps are also a red herring. As pointed out upthread, on that stretch of road there are none. This entire thread is speculation, we really know the square root of bugger all about what actually happened.

Are Police saying the cause of death was impact with car or just that car contacted a man who subsequently died?

I don't believe you can knock someone down or run over an inert body causing fatal injury and not know it. On the other hand one could perhaps nudge or catch something unseen with a the car's nearside bumper or wheel and put it down as the kerb, or a pothole?

Headlights are not required on any road with lit street lighting.

  • ensure all sidelights and rear registration plate lights are lit between sunset and sunrise
  • use headlights at night, except on a road which has lit street lighting. These roads are generally restricted to a speed limit of 30 mph (48 km/h) unless otherwise specified
  • use headlights when visibility is seriously reduced (see Rule 226).

That's rather ambiguously worded.

(a)during the hours of darkness, except on a road which is a restricted road for the purposes of section 81 of the Road Traffic Regulation Act 1984 by virtue of a system of street lighting when it is lit; and

RTRA said:
81 General speed limit for restricted roads.

(1)It shall not be lawful for a person to drive a motor vehicle on a restricted road at a speed exceeding 30 miles per hour.

That's rather ambiguously worded.
That's interesting. HC does seem not to have interpreted RVLR correctly. Interesting also that section 25 RVLR refers to section 81 RTRA as the definition of a restricted road, when it's section 82 that's the definition and section 81 is the speed limit.
