Just been hit

Hi all,

An hour ago I was hit by a women not giving way, luckily im ok, wrist is sprained, graze to knee, elbow and side of buttocks, I managed to get out of most of the inpact and jump right but was dragged at the side. I need to visit the hospital tomorrow for an xray to be safe.

Police and ambulance came and woman admitted fault, The womans exuse was "I was looking for headlights" and "I didnt see him", she showed no remorse or asked if I was ok.

The police fined her £30, but couldn't do her for dangerous driving . I have her insurance details now does anyone know what i need to do?. My bike is bent, I think the frame is bent?. will I get compensation?, I have no bike now and cant afford another.

The ctc legal advice is good but I've also heard some people saying they aren't really interested if its under £1k; I think my first phonecall would be to there though, good luck and I'm glad its not too serious.

afaik ctc and bc can insure you retrospectivly which means in effect that u were covered at the time ,,,,its well worth spending twenty quid or so ,,itl make things a fair bit easier

What was she fined £30 for and why can't they put her forward for prosecution under dangerous driving?

I would double check about the CTC and BC insurance covering you if the accident happened before you policy was taken out. Their personal injury claims (which is completely different) does work like that.

That is standard practise in personal injury claims, under £1k claim and they can't claim costs from the other side. In the long run it isn't worth them doing the work and you paying them as you end up out of pocket.

Will I get a call from her insurance company tommrow?. if so what should I say if im going to get ctc or another to represent me?. My bike is a gt aggressor 3 old now around £400 at the time I bought it.

I would certainly want some to represent me. I would either follow the advise already given and contact CTC. If you chose not to do that, then I would advise a solicitor. All costs should be met by the womans insurance when all settled.
If your a trade union member you may be able to get free advice from there solictors, I know that is the case with mine and this advice is usually free.

I think the police officer is wrong. A similar thing happened to a friend of mine. The driver was charged with Driving without due care. She was given the choice of court or to attend a driving course.

Make sure you go to hospital/doctors and get your injuries recorded. I would also take some photographs of your injuries and your bike. Maybe worth returning to the accident site and also taking photos of road layout etc. Always best to be prepared, just incase.

If there are no significant injuries, then you can claim directly from the driver's car insurance. You should have been given the details of the insurance - if not you can get them from the police or get a contact number for the driver and get the insurance details direct. If the police have already established that the driver was at fault, there should be no problem getting the insurance company to pay out for the repairs - based on a quote from a reputable bike shop.

You should contact the insurers and ask for a claim form - the driver should have informed them about the incident already. If you want to claim for personal injury then you can do that as part of the claim. If it does turn out that you have a broken bone, then I'd advise getting some legal advice.

loads of firms out there that will do it for free if they think they can win as she was fined and admited fault ,it bingo , but will take ages
