I'm getting some right annoying bastards on youtube who are stating it's against the law to record video whilst on the road, and i'm braking various laws by uploading videos on to youtube because i'm displaying numberplates etc...

I don't think there is anything wrong with it. i'm displaying and shaming the cars that are braking laws and putting my life and others lifes in danager.

There is no way to relate the car to the driver, where they live etc.

I feel they are just trying to piss me off, but i want to know if they are right or wrong before i proced with a witty response..

AFAIK they are wrong as there is no expectation of privacy in a public place. It would be different if you were pointing the camera into their house or garden.
 
I have had e-mail correspondence with the information commissioner in Scotland who confirmed to me that videoing and posting on youtube as I do is exempt from the data protection act under the recreation exemption. I have the correspondance so if you want a copy I can certainly forward it to you.

The act is UK wide and thus the situation should be the same in the rest of the UK as AFAIK.

It's very amusing though how so many people think "that can't be right" or "I'm not keen on that" and then spout it off about being illegal rather than looking up the facts!

Aye, there are a lot of armchair lawyers in the world of youtube.

Is it recreation if you are commuting to work though? I would have thought this counted differently compared with videoing a leisure ride.

Apparently so. I gave the IC all as much info as I could about what I do. At first they suggested that I needed to register, then after some more discussion and though (Internal to the IC) they changed their mind.

We can only go on the advice they give us! :biggrin:

Oh the ones that really mouth off know the law. They do it to cause conflict, troll or to try and make others think we're the bad guys.

Incidentally, one of the guys on youtube thrashing out the same troll arguments about legality actually has been seen commenting about the BNP in a rather favourable way. :becool: I forget which videos I saw him on, but he has uploads of his hospital radio show, and some copyright infringments on his page, LOL. Clever lad :biggrin:
