It qualifies for replacement under warranty, there's no question of that. The question is; do you want another one the same?

Mass production being what it is it's very unlikely that only one frame out of however many they produced in that run will suffer this problem. Whether it's a problem of faulty materials or of processes you can bet that the frame preceeding it and the one after it will suffer the same failure - if not the whole production run.

See what they are prepared to offer you but if I were you I wouldn't accept the same frame as replacement.

Unless the frame was damaged in transit somewhere etc.

You make a point - although I would do more research, gaz has only had it for 2 months but the frame has probably been in production for longer... if these frames were cracking often im sure we would see it around on the interwebs (might be worth doing a search).

Unless it was a recent production run, and older runs are fine but then again your replacement frame might be from a different batch too. Im not really sure how the shop will react to wanting to return the whole bike...

There simply shouldn't be an issue. About 12 years ago my son had a chainstay crack on a week old bike (not quite a BSO). The bike shop (in Ipswich) phoned the importer and a new bike, next model up the range, appeared from the back of the shop to replace it. An hour later it had had its pre delivery set-up and was on its way home.

That's the service and response you should be getting.

Anything else and the GregCollins approach is appropriate.

I remember as a teenager my brothers Townsend falling to bits when it was new. My dad was away at the time so my eldest brother went with us to the shop and
I distinctly remember him saying in a loud voice Basil Fawlty like "this does not work, it is not therefore a bicycle" to the manager. At the time I think I was cringing behind a display stand. The end result was a higher spec bike as a replacement.

It's not the fault of the shop that the bike is broken or the fault of the manufacturer. It's just one of those things. Replacement is a nuisance but should be straight forward. Do not ride the bike at all, it is not safe

So yesterday AM Was cycling to work, and all seemed good, but I thought my seat post had slipped after about 8 miles, so I stopped, raised it and then flew for the last 4 miles.

Then last night I felt too far back, stopped, raised the seat post again and set off, it just didnt feel right, but I was on slicks on a boggy canal so I put it down to that, then when I was home I washed it, but I noticed what I thought was paint peeling, on closer inspection the frame around the seat post area is cracked, I have never crashed the bike, its only just 2 months old and I dont weigh 39 stone, so how can this happen and I'd assume there shouldn't be any issues in getting it replaced ?

Where is that on the bike exactly? Doesn't look good - classic fatigue failure at the toe of the weld, which should NOT happen on a 2 month old frame. Suggest either forces are WAY in excess of what they should be, or a serious material defect from build. Doesn't look like a welding problem, so shouldn't be seen on other frames.
 
Disagree. It's a CAAD 8 which is an excellent frame.

Disagree? I know of at least one CAAD 8 Cube LTD frame which has suffered a catastrophic failure. Not so excellent then.

I was just about to say, that not like any CAAD8 ive ever seen. I'd be very surprised if there were welds like that on a CAAD8! My CAAD9 has super nice welds.Shame about the little rough bit inside the seat tube that scratched my seat pin to sh*t though.

so how much seat pin was there below the centreline of the frame junction?

I've seen this happen, and seen the shop reject the request for a refund - and quite rightly so. You're going to have to satisfy somebody that the seat pin wasn't too high. A third showing sounds good - very good - but can you demonstrate this by showing them the line of the pin?

Had a better look at a Cube LTD Team 2011 on Google.

Yes - the only reasonable explanation for the failure would be seat almost out of the seat stay. Which given that you are only showing a 1/3, is ridiculous. Unless you have been lending it to your super-tall mate.

So, either frame has been damaged before you got it, or there is some serious material or assembly defect that has caused the failure.

Nop, the seat post was fine, the bike actually had its first "service/safety check" last week, so I'd have issue if they said that caused it but didnt tell me after they "checked its safety"

Anyways, what they said was:

"Oh thats a crack that, it's either going to result in a new frame or whole new bike, we will contact Cube and let you know what they say"

So all "good" I shouldnt be in the situation of being without it when its such a new machine but hey ho, at least it's getting sorted.
