In theory no, in practice yes, especially the Police, they watched one of my close pass videos and said I was partly to blame because my tyre could be clearly seen (about 4 inches) to the right of the fog line (the white line marking the edge of the road) whilst the Road Code says cyclist should be about 1 meter from the edge of the road.

So in NZ they would never expect to see a cyclist in the lane with the car?

They do expect to see them, they actually look forward to seeing cyclists on the road.
