A few weeks ago I had a close pass by a asda hgv, I reported this to asda but with the driver being from an agency they could do nothing.
So last night I reported this to the police.
After half hour conversation the officer said its not right but there is nothing the police could do as the CPS would disregard it and say its a wast of resources.

So it looks like passing at speed within inches of a cyclist is allowed in Hull.
Unless you guys could advise me what to do next?

I'm sorry, but yes, it was poor driving, but what would happen? CPS would not bring a case of careless driving as there was no actual collision. Put it to bed and move on. The consequences of being hit by a truck are unthinkable, but they didn't actually happen, so thank your lucky stars and keep on riding.

Welcome to the world of reporting something to the police.
At present it's just your word against his, the policeman is correct, the CPS will not even look at a case like this, it's not in the publics interest* to go charging every tom dick and harry that passes a cyclist too close.

What can you do now, write back to Asda and tell them it is up to them what they do, but agency driver or not, it's a livered vehicle and is endangering other road users and if they are fine with that, then it is only damaging their reputation as a company.

What to do in the future? If you really want to do something about such incidences, then get a video camera and record your journeys, that way if anything like this does happen again it is much easier to apply pressure and show people just how bad it was.

*By publics interest i am referring to the costs involved to charge someone, along with the time involved in court.

I live near a ferry port like you. The worst are Polish HGV drivers. Its quite a skill to miss a cyclist by inches but its one they have perfected.

Thanks for the reply.
I do video ever commute also upload to YouTube, then email the link to what ever party. It suck the fact this guy has got away with it. I'll wright ASDA a strongly worded letter and see what I get back.

I live near a ferry port like you. The worst are Polish HGV drivers. Its quite a skill to miss a cyclist by inches but its one they have perfected.

The good thing about Hull is there is one road in from the west and one road from the north, it's really easy to stay away from the routes the HGV drivers use.

ASDA say they can do little? If you were to upload a video clip of one of their sign written lorries being driven dangerously, and have that video clip found when the key word of ASDA is used, I reckon they would take a little more interest, I reckon both the agency and the driver would be read the riot act.

After having two near misses myself with badly driven artics in the last two weeks, I have decided to join the ranks of commuters with cameras strapped to their heads, ordered myself a dogcam last night.

After the manager told me the bad news. He kept asking what else do I want and do I want anything else, as if I was going to ask for a bribe.

You could write to your MP using this link I had a tax problem several years ago and wasn't getting very far with HMRC so I wrote to my MP to take it up for me. Believe me people started to jump about then. If you have got video evidence then it is in the public interest to have it properly tested by the CPS and if appropriate the courts. Just write up a brief statement of facts and send it to your representative then sit back. Things will suddenly begin to happen particularly if you have the name or number of the police officer you spoke to.

Asda can't directly discipline/advise (or whatever) the driver - fair enough.

But they CAN (should?)

- pass the message back to the recruitment agency that they are concerned about the competence of some of the drivers they are supplying, particularly as it reflects on their (Asda's) good name. Aye - and every "consultant" in that agency (on commission) would get the message and pass it on to all their drivers!

- pass the message back to the agency that so-and-so driver is not welcome for any further jobs with Asda.

T'ain't rocket science - or even a lot of effort?

It was written on the front of the truck. I cought up to home a few miles down the road and told him how I didn't like his overtake through the medium of hand signals.
