I'll head back tomorrow and get some better photos, cheers. Out of interest, what do you mean by "this, that and the other"? I'm guessing I'm in for some fun...

Basically they'll have a strict set of specs before they'll consider a payout, basically to save themselves money. I saw somewhere potholes have to be 2 inches(!!) deep before they're considered bad enough.

How come things like this happen more often it seems to people wearing a camera, or is it just me.
Dang I have to stop wearing my cam in case one of those pot holes jumps at me. LOL:laugh:

What I am learning here is that the english are just as litigious as Americans.

This is road repair in Saskatchewan. Sometimes they do not even put up the sign, they just put up hi vis flags at the start and end of the pothole.

Show me an Englishman who's sued for "mental distress" after seeing a boob on a pregnancy magazine cover (and yes, it's happened - can't find it online but I read the article about it).

If somebody else causes damage that you then have to pay for, wouldn't you claim? If a friend damaged your bike, you'd want him/her to pay for it so why not the council?

That depends whether it is active or passive damage.

If they rode it up and down pavements and the wheels got buckled, then I'd expect them to pay.

If they parked their car in your drive and you rode straight into it because you weren't concentrating on where you were going, then I'd not be so certain. :thumbsup:

I believe that the highway authority has some sort of defence if they were unaware of the defect. Evidence of a previous report is crucial for a claim to be successful.

As for whether or not you should claim I must say I wouldn't give it a second thought. You pay your taxes to the authorities and their duty is to spend that money 'inter alia' on maintaining the the road surface. If they have failed in their part of the bargain and it has cost you money it is only right that they should pay.

If this had been the cause of you coming off and going under the wheels of an oncoming articulated lorry. Who then would be saying just take it on the chin. Certainly not the lorry driver who is being investigated or even gripping the rail charged for causing a death by careless driving.

I wouldn't have any concerns about how the council might be better spending the money. As like as not if they don't pay it to you it will go on financing their expenses or some lavish foreign jolly to research how they do road repairs in St Tropez!

I think there are many better ways to address the issues we face on the roads than seeking damages for riding into an obvious pothole. That's not holding people to account, that's selfishly abusing blame culture. IMO.

Fortunately, for the rest of us with an interest in seeing the roads well maintained, the courts do not share your opinion.
