Being in a worse mood than when I originally tried to post having been booted out of my log-in as I pressed the submit button I'll try again. And once a **CK*** gain!

This was originally a stream of consciousness post as I needed to vent. I'm being a lot more measured now as I try to post for the third time.

I was trying to write a factual account of what had happened to my mother-in-law and her family over the last six months for other purposes. I couldn't as I was too angry and I decided I needed to get something out and came on here to vent.

It's been quite terrible, we feel badly let down in some areas, appallingly in others. Some of the difficulties we face now are due to, perversely, how lucky we've been. Without going in to detail it would seem from the outside that we've been let down most by those that in fact have been the most helpful - so it wouldn't be fair to make too many judgements about the services that should have supported us.

The family is still ignorant of several key facts (we don't know exactly where the incident occurred, we haven't been provided with any insurance details of the driver) and can't verify what we have been told so the following is a best guess/amalgam of what we have been told.

It was dark. There was heavy rain.

My mother-in-law was struck while crossing the road by a 4x4 vehicle.

The vehicle didn't stop immediately but returned to the scene later.

Between the incident and returning the driver picked up a passenger.

The distance she was thrown, the severity of injuries and the opinion of witnesses suggested the impact speed was approximately 50mph. The speed limit was 30mph.

The driver apparently sounded their horn but did not attempt to brake prior to the impact.

She was fortunate to land near to the car of a doctor that performed CPR and was aware of and stressed the severity of brain injury.

She suffered possibly multiple severe blows to her head. Several skull fractures, a fractured jaw, she lost most of her teeth and had several deep gashes to her face. No other part of her body received substantial injury.

CCTV was not working in the area.

My mother in law was in a state of Post Traumatic Amnesia for six weeks.

After emerging from PTA and being discharged she has received no other rehabilitative therapies.

Her recovery has been miraculous, however she does suffer from short term memory issues and increased volatility. PTSD is beginning to manifest. There are other issues that are too complex to explain here.

The driver attended court on the 18th December to face charges of: driving otherwise than in accordance with a licence; leaving the scene; perverting the course of justice.

Today we received our first communication from Victim Support notifying us that the driver had pleaded guilty to the first two charges, had their licence endorsed and was fined £66.00.



£66? We've been waiting four months for the criminal case to be closed so that we can see the Police report that we paid twice as much for.
We've been stopped from pursuing our compensation claim until this insignificance is dealt with.
I'm putting down a deposit on some new teeth for my mother-in-law on Friday. It's going to cost more than a hundred times that.
£66 is supposed to be a deterrent to leaving someone dying in the road? FFS

I can't begin to imagine how I'd deal with that lot - a truly sickening incident from start to finish.

Ben I'm so sorry to read that. I'm appalled and it sounds awful and a real f*****g nightmare -no words can make it easier- we're here for you if you need to vent - you're not alone mate.

We'll get some advice. We need to expend our energies where we'll get the best returns. If compensation turns in to a nightmare then we may need other outlets and a private prosecution might be it. We feel pretty worthless at the moment.

Well all the best of luck to you guys Ben, I am sure there is an option and am sure someone on here will have a better idea if you can indeed go for private prosecution. Perhaps a no win no fee solictor?

Don't feel worthless mate, your M-I-L is alive & getting better and that is all that matters at the end of the day....

Ben don't let the shoot justice system get to you - you guys aren't worthless though it indicates some of the pressure you're all under.

Stay strong, try and be positive and look for all the resources - that's how I'm trundled my way through horrible situations.

If there were not witnesses, given the severity of her injuries, why wasn't the CPS/Police looking to charge the driver with at the very least undue care or Dangerous driving if it could stick ?

I see it as a failing on their part if they couldn't gather enough evidence to bring this about given what you have stated here.

Without either conviction against the driver, I would see a real struggle by your MIL to have the blame laid at the drivers door.

My friend had a serious accident on my m/cycle 8 months ago and the driver who caused it was convicted/admitted undue care. This makes his case very strong, but he was told today by a specialist in London that he will need a nerve graft within the next couple of months to gain any real use back of his arm which is really quite knackered now :biggrin:

I went through the serious injury and compensation process myself years ago but mine was a lot more cut and dried than your MILs as the ridder who caused it was convicted of undue care.

She really needs the best representation she can get her hands on, and it is a long process. Try these people, they are representing my friend and are very good at what they do http://www.mcmillan-williams.co.uk/brain-damage.html

Very-near, I don't know why a charge wasn't brought against the driver on the basis of the quality of their driving; as I said we haven't been given even the most basic information. We have received only one official communication from the police. They have been extremely evasive. They have not met their obligations to my mother-in-law or her family. We have a specialist road accident/head injury solicitor who until this point has been completely hamstrung by their prevarications.

You might ask your solicitor to approach the IPCC (independent police complaints commission (sp)) if you feel they have not done their job properly.

My friend was tied up by the evasive nature of Glos police and was only aware of the drivers conviction bscause he rang my mate to tell him of the court case humself (being a decent chap who made a genuine mistake and doesn't want my mate to suffer any more than neccessary for it).
 
There are no words to describe how horrible that sounds and how angry the outcome of that court case makes me feel. :angry:


All I can do is offer you, your Mother in Law and your family best wishes.

Good luck with taking this further. I know personally I would pursue this with significant vigor. There is no way that £66 is any form of justice. :angry:
