a continuation of my divorce thread, so I need a solicitor,
Does anyone have any knowledge of how to find a good one in a particular field, in my case, divorce.
Only ever used them for house moves and my will, and if they were all the same as the ones I used for moving house then I'm surprised anybody actually moves because I seemed to do more chasing than them!

I don't know much about it other than they specialise, so that the one who did your house wouldn't be the best for you now.

And when we went for buying our house we choose one we could speak to and meet rather than an online place that deals in bulk meaning they would know our case better.

Don't seem to have any choice mate

I would rather give all my goods to charity than go down the Solicitor route , two friends recently divorced and were both on good terms with soon to be ex wives until the Solicitors became involved , both walked from the marital house , they both had no kids ,One used a Solicitor and the other didn't , one of them ended up £4000 out of pocket and the other ended up with £10000 on his hip , you can guess what one .

If I knew then what I know now I would have represented myself. There's no profit in an early settlement for a solicitor and I found things only got nastier once they got involved. I seem to recall it's possible to do a DIY divorce, at least you don't have the added complication of having young children. Maybe the Citizens Advice people could help you on this.

I thought the same, I thought mine was simple, it was simple, everything pre-agreed, just need a lawyer to 'ratify' everything and make it straight, right?

Wrong.

They will find complication where you thought none existed. They will find conflict where none needs to exist. They will make the process a lot lot longer than you ever thought possible.

I'm no mug and she was a brilliant solicitor but seriously, if you can do DIY, then take it as far as you can.


My friend had everything sorted as well and didn't use a Solicitor ,they had agreed 10k and the car for him to walk away and that's what he got in the end but his wives Solicitor managed to drag it out for 2 years and persuaded his ex to pay for a separation agreement before the divorce , there was no kids involved .
 
Also change your will sooner rather than later as well. Once I knew my marriage was over one of the first things I did was write her out of it and leave everything between my two boys. You can do DIY wills also, I did my mum and dad's. When she passed away it sailed through probate.

Have a look at Family Mediation. Not, as its name suggests, a "make everything better" service but family mediation can help you to make arrangements for any joint property, finance and children. Less expensive, theoretically, than a solicitor.
Although agreements made in mediation are not legally binding, National Family Mediation agreements made in mediation are acceptable to courts and lawyers, and there is a mechanism through which we can help you make the agreement legally binding.

I used this site 16 years ago. Worked perfectly. £89 quid plus the court costs at the time. Sorted. Bosh. Tuesday.

I'm a Solicitor. I don't deal with divorce but I have colleagues who do.

They always signpost people to family mediation. They offer a free initial half hour. They help people going through hard times to get an acceptable outcome. Client recommend them to their friends and acquaintances.

They help people going through mediation - you may want some advice as you go through the process.

Obviously each case is different, but when you do have something to preserve by way of capital, you might want to consider taking some advice and giving yourself the best informed choice.

As a solicitor, I would advise you to instruct a solicitor as a last resort. As others have said, instructing a solicitor will cost you.

The paperwork for a divorce is very simple to do yourself.

The financial side is more complicated, as are arrangments re the kids. However if you instruct solicitors, you both end up with lots of cost and the assets have to be used to pay for these. Far better to try to make sensible arrangements with your spouse. The key being sensible. Two cannot live as cheaply as one. Your lifestyle will suffer - face up to it. Its not about preserving your lifestyle, its about dividing the assets in the fairest way in the circumstances.

Also remember that past behaviour does not affect the division of the assets, unless behaviour was extreme
