Apparently, some driver in Swindon has amassed a massive 39 points on their licence but are still allowed to drive.

It appears getting 12 points is not an automatic ban if you can show it will bring you extreme hardship.
 
Mr Loophole was on Radio 5 Live this morning - apparently if you clock 12 but have a good case then you carry on driving. If you get to 24 in a 3 year period then you have to provide another good case but not the same one as you gave after the 12 point hearing etc etc.

There must be some gullible magistrates around.

I imagine some of the people driving on 12 points or more are taxi/private hire drivers as they will have no income without a licence.

A driver in Swindon recently got 6 points for driving at 49mph in a 30mph, taking him to the magic 12 points, only to be allowed to continue to drive as he was a sales manager and would loose his job, house, wife, kids etc. The magistrate seemed to miss the fact he was caught speeding on a road out of the village where he had lived for 10 years and the driver stated he did not realise it was a 30mph zone.

That is so stupid!

If a person has to drive to maintain their income then you'd think they would drive much more carefully to ensure they don't lose the licence!

I heard that too on the radio and the fact that in the BS and BA postcodes there are 250 people with more than 12 points on their licences who haven't been banned. I agree with the above if you need your licence for your income then you look after it.

Pardon my ignorance, but I thought the whole idea of a punishment was that it caused you some hardship?

Apparently not if you look at some of our "hotel" prisons.

I think that the issue is proportionality. Punishment should be equal, and if someone looses their entire livelihood, this is much more of a punishment than if someone has to use taxis and buses for 6 months.

But someone caught speeding who relies on driving for their job must be doing an awful lot of miles at excessive speed... only a matter of time before they hit a third party who would have been saved if the speeder had been banned earlier.... speed awareness course after 6 points, 3 month ban after 12 points- then everyone knows the rules- 1 year ban after another 12 [cumulative 24 points], 3 year ban after 36, but lose licence and never drive again after 48 cumulative.

Anyone incapable of driving sensibly shouldn't be on the road to start with.... it's not rocket science

Tough ****ing shoot if you ask me. How is that any different from arguing that you should be allowed to steal food as you're a bit skint? Actually, that's a more reasonable argument.

Quite. In any other activity that imposes risks on others, you'd be held to a higher standard if you did it professionally.
