It's grounds for divorce, under this country's archaic divorce laws, but I don't think it's a crime or an offence of any sort.

And it's only grounds for divorce if you do it with someone of the opposite sex.
It's illegal but not a criminal offence.
Also, I think men can commit adultery with other men, I think it's the act of penetration that defines it.
So non penetrative sex is not adultery.

Is transgender recognised in law? I guess you're dealt with as the sex you're assigned on your birth certificate if not.

Well, as the birth certificate is changed, yes you are.

Still could get complicated if the birth certificate was changed between the time the adultery occurred and the case comes to court.

But really, this should be irrelevant. Again, the marriage is over, why drag multiple people's personal lives through the court?
An at fault divorce doesn't necessarily get dragged through the courts in the way you imply. If both parties agree it can be rubber stamped in the same way a no fault divorce is.
Perhaps it's important for those involved to go through the process? Ritual is very important on many different aspects of life - birth, marriage, death. divorce has a massive impact on family life, why should it slip away unnoticed and without a true reflection of what happened?
I had an at fault divorce. It was of great significance to me that the actual reasons for the end of my marriage were reflected. Irreconcilable differences didn't cut it and would have been dishonest.
