It seems if you are caught using a mobile phone whilst driving and deny it, the Police/CPS will/cannot do anything about it.

Police officers who have reported persons for this offence are finding that if the motorist pleads not guilty it is increasingly difficult to prove to the satisfaction of the court that the offence under Regulation 110 of the Road Vehicles(Construction and Use ) Regulations 1986 has been committed.
(6) For the purposes of this regulation—
(a) a mobile telephone or other device is to be treated as hand-held if it is, or must be, held at some point during the course of making or receiving a call or performing any other interactive communication function;(b)...(c)(i) “interactive communication function” includes the following:(ii) sending or receiving oral or written messages;(iii) sending or receiving facsimile documents;(iv) sending or receiving still or moving images; and providing access to the internet;
The problem in the current economic climate are the Police/CPS willing to go to court for a "minor" driving offence if there is a chance the prosecution will fail. The general feeling locally is the Police/CPS have given up on "minor" crime, unfortunately the list of what is considered "minor" seems to be growing.I think it's a fair point, but lets be honest, we all know about this law and there is little reason to hold your mobile phone whilst driving. To be in proper control of our vehicles we should be concentrating on driving and be holding the wheel with two hands.

Things like driving whilst on the phone which is dealt by an FPN, only goes to court if the driver chooses to do so.
