I think it's the cost of the claim that has made them stall from what we have learnt anything under £500 will be paid out without fuss. Anything over this and they get a third party involved to look at the eveidence etc.

I paid for the dealer to do s tech report on repairs and take pictures then used my AA membership to independently assess. Cheshire paid all out and some for compensation .

Surely it would have exactly the opposite effect in the event of a claim? :huh: The fact they have sprayed paint around it proves that they were aware of it but have neglected in their duty to do something about it.
Possibly not. They will probably also have photographed it and noted its depth and radius and will be more able to argue that it was of a size that a vehicle should expect to be able to traverse without damage (the size will be documented in their Transport Asset Management Plan)... unless it wasn't, in which case they'll know they haven't a leg to stand on, but might try bluffing for a bit to make you think it was. The photographing/painting also demonstrates that they are carrying out the routine inspections required by law with reasonable care, removing another avenue for people to claim.

This must be correct; when we tried to claim from Lancashire CC for a bent wheel they sent us a huge envelope full of hundreds of defect reports and claimed that, since nobody had reported the pothole, they couldn't be blamed.
