I agree. On an uncongested motorway, if you're driving (as you should be) in the LH lane and you catch up with a idiot tootling along in the middle lane, then the only legitimate way to overtake is to move over two lanes into the outside lane, pass the aforesaid idiot, and then if it's clear, move back into the LH lane.
In my experience, about 50% of the time the overtaken driver takes the hint and moves into the LH lane once you've passed them. The other 50% are beyond hope.
