Hey guys,

Evans Cycles is consistently fobbing me off over my bike.

To recap: Since buying the bike I have had a consistantly squeaking chain guard. After the 6-week service that it recommends, the squeaking is still there.
In addition, I have had to reindex the gears, the back brake seized up, the seat bolt has sheared off then a spoke went.
Because I commute, it has been taking it to the nearest bike shop (in the case of the brake and spoke) so I can get to work.

The nice LBS that did my brake didn't charge me while the spoke cost me £16.

As a result, I feel that either I was sold a dud, or at 6'2" and heavy build that I was sold the wrong bike/frame and badly advised.

However, Evans Cycles' "customer service" say that because I took it to other bike shops rather than try/risk cycling to Kingston and miss a morning's work at the least, I invalidate any claim I may have had and also missed out on the returns policy apparently.

Thing is I am getting issue that would maybe affect a three year old bike not a three month old bike.

I am angry and at a loss what to do next. Am tempted just to throw the bike through the window of Evans Cycles - I know I wouldn't hit anyone because there's usually bugger all people there to serve customers!

Arrgghhh!

I would suggest you contact your local Citizen's Advice Bureau and ask for some advice regarding the Sale of Goods act.

Guess that't the next step - I emailed the chief executive, only to get "customer service" replying again.

Might try him one more time.

Complain via Twitter. A work colleague does this every time and gets issues resolved the same day quite often. The bad publicity travels fast on Twitter and they take note, I guess?

Pick up the phone, forget email

CAB for advice on sales of goods act. Did you pay outright with a credit card? Offers some protection too

Sorry you've has all this to contend with.

I went through a similar stance with Halfords (ducks for people throwing things at the mere mention of the name) Take it as far as needed, if the goods were shoddy in the first instance then you're covered under the sale of goods act. Taking it elsewhere will only effect the work and goods the other place supplied or were part of. The original goods should be checked out by Evans either way to ensure safety.

If you honestly feel the original goods were not up to standard write to them with the opening, 'I have been legally advised to write to you... blah blah you need to check over the original good supplied as I do not feel they are fit for purpose... blah blah... sales of good act/ lost confidence in your company so i went elsewhere.

See what response you get.
