I had a very similar experience 20 odd years ago when i was an assistant manager for a local supermarket chain i was told i was not good enough for the job but could i train mr XX do to it who was related to one of the company owners.........

I left .

job applications have to be assessed without discrimination. You can't pick and choose on the basis of race, gender, disability, age or whatever. If jobs are going to friends then that might be discriminatory - if were shown that the effect is to discriminate against people who are black, old, women, gay, Sikh or Blue Helmet Wearers. Put simply, Mr. X, you have a case. Proving it, and proving that you are on the wrong end of discrimination might be difficult. On the other hand the company might be called on to show that they hire without discrimination - and this would be tested by what they did as well as what they have on paper.

I know (and you and I mention) that the law can protect from discrimination, racism and sexism. But can it protect from favoritism?

The story re Police Chief I mentioned as it a 'public worker' who has abused his position of trust. But in this case Xmister has applied for a job at 'Bobs Doughnut Factory', but 'Bob' has turned him down and given it to 'Ruprecht the monkey boy' who happens to be 'Bobs' nephew.

Its not a public role and not breaking discrimination laws to do that, or am I wrong?

Discrimination against age, race, disability, gender, sexual orientation etc. during recruitment are against clear statutory requirements, but nepotism is not.

The only potentially meaningful recourse, as far as I can see, is if the MD is unhappy with the HR Director and the hiring manager already, then a direct, measured, letter to the MD explaining why you are eminently qualified while the hiring is seemingly not in the best interest of the company might just achieve something - it might just be the ammunition he/she has been looking for; perhaps you can check with your friend inside, but I suspect it is going to be a long shot.

What would you be looking to achieve with that? In the very remote chance that a letter to the MD slagging off members of his senior team with unproven allegations of nepotism is treated as anything other than defamation, would you want the job?

His friend on the inside might even be using him for personal political games, and now you suggest that he puts the above in writing?

He failed, for whatever reason...

Agreed on the lucky escape, there might well be some bad doodoo is going on in that company.

You can turn this to your advantage. Offer your services as consultant without any bitching. You are skilled they need that skill and still don't have it.

Would you have been happy to have got the job if your friend on the inside had pulled some strings (like advising you of what to say on the application), or maybe having a quiet word with the hiring manager?

It's tough luck I'm afraid, I bet that you are a better prospect for the company, but some firms are utterly clueless and can't see the long game.

Beyond everything that's written on a CV or said about suitability there is 'face fits' too. Perhaps your interviewers found something they didn't like about you. Perhaps you came across too confident and they didn't want a cocky upstart in their midst... who knows, there's a myriad of reasons outside of the officially discriminatory ones that could have meant you were not offered the job. I was offered a job once and one of the reasons I was offered it was that I didn't wear a watch!

Forget best you can and move on.

Actually I wore a crotchless gimp suit to the interview and told them I was ready to assume the position.

Seriously though, I've stopped being angry about it and am going to put my focus into my freelance work; stuff being employed by someone else!

xmister - well done, move on. A person of your integrity would have admitted to knowing 'someone on the inside' and put yourself at the mercy of the interviewing panel in any case - the tenet of your post more or less says that! Well done for being scrupulous.

If it's a plc you could always buy a few shares and ask a leading question at the AGM!

Or do as I did - work out how long the useless and incompetent management are going to take to sink the company and see how accurate your prediction is. (I predicted 5 years and it took 6).
