One of my favourite prosecutions was an old dear driving an unregistered lawnmower on the road. That was an expensive lesson she won't forget.

And yes, all mechanically propelled vehicles, whether classed as motor vehicles or not, are covered by the RTA, so the hobby was quite right to ticket chummy.
Oh dear......I have visions of a 100 year old granny with dimentia who actually thought she was driving her car.....while Drago hands her a ticket and threatens her with 20 years in the slammer.

If the gardener involved thinks it is ok to use the phone on a motorised mower, could we not reasonably assume that he will use it when driving his car/van?

Not sure that holds up. Driving a lawn mower at walking pace might not occur to a lot of people as being really driving. Presumably you could be busted for making a phone call whilst operating a pedestrian controled vehicle - which is basically a hand cart albeit petrol powered.

What about an e-bike?
Could you be done for using a mobile on an e-bike, but not a normal bike?

There is no law against using a mobile phone while on an e-bike. However, you could still be booked for dangerous or careless cycling if you are deemed not to be in full control when doing so.
