Thank you to everyone posting messages of support, and information and advice  I must admit I was quite nervous about checking back on this today, just in case.

Thank you Crankarm for all the info - I'm sorry your case dragged on for four years. I very much hope that won't happen to Dave as well. It must have been a nightmare having it hanging over you for so long.

I haven't spoken again with the investigating officer, so no update on any of that. He seems strangely forthcoming with information regarding the driver's statement etc, but as I said yesterday I am just incredibly relieved that he is now being supportive.

Dave's latest xrays show that his lung has still not reinflated. On the positive side it looks as though they won't now be operating on the collarbone, so hopefully that means the break is less 'complicated' than they originally thought - although the consultant has yet to explain the reasons.

Anyway, thanks again for everyone's help and advice.

Thanks for updating us on Dave's condition. Hopefully his lung will re-inflate soon. I'm sure we would all like to sign a virtual Get Well Soon card for Dave.

Just to add that the reason mine and other personal injury cases tend take a long time to resolve is because some injuries take a long time to heal and prognosis can be uncertain even several years after the injury was inflicted. For instance injured parties may still be receiving treatment such as physio or PTSD counselling. In settlement specialist advice is always sought which may also cause conflict between parties which can drag things out. That's doctors and lawyers for you ;).

Only just seen this thread. So sorry to hear the news Tricyclista. I wish Dave a speedy recovery, and hopefully over time his injuries won't seem so bad. Not that I don't wish that driver to be permanently off the road, of course, but that's another matter.

With regards to some of the negative comments, please don't take them to heart. Without all the info, and with previous recent trolling on these boards, I think that its easy to be wary of new posters.

I often see Alyson France of Bikeline recommended as a soliciter - I've heard nothing but very good and excellent feedback about her.

p.s. the independent witness is talking utter rubbish about Dave cycling too fast. It's common for drivers to spout this sort of rubbish, and it's usually when they're sitting behind you or trying to overtake. Maybe they think cyclists shouldn't go any faster than 5mph or something stupid like that?

Lee, I know you're a decent bloke, but that post came across well badly. A sorry to the OP?

Thanks everyone for the support and well wishes

Dave's lung has finally bucked its ideas up by the sounds of things and **touches wood, crosses fingers** they are going to take the drain out tomorrow all being well, which means he should be home on Wednesday :hyper:

Last night he had an allergic reaction to his latest pain meds and had to have a doctor called to his bedside in the middle of the night, and the doctor then managed to prescribe him a different pain med with the same active ingredient  Luckily a nurse spotted the mistake this morning before administering it! I hope he is home on Wednesday as I'm now convinced that between overworked doctors and NHS food they'll be finishing him off! Apparently never order the porridge if you find yourself in hospital

Thanks again everyone. I'm sure I will be back on here with lots of questions once the legal proceedings get going.

Can't offer any advice as I'm new to all this myself, but I hope everything works out for you and I wish Dave a speedy recovery. Take care.
