If I were the accused, I might say that while I was taking part in the race there wasn't enough evidence to identify me from the footage. Or if I had admitted that I was the rider in question, that I was taking part in an advertised race on open roads, I was boxed in and it was my only route through short of crashing into them both so I was giving the horse rider due consideration in the circumstances.
