The insurers are liable for any damage their client causes, whether deliberate or not.
Not strictly true. IANAL (but I know something about insurance). If there is no fault, then there is no liability and hence no claim. If it is reallly an accident, then you can't claim against the insured. If it is the driver's fault, then (s)he is liable in law for the damages (s)he causes, and that is precisely what third-party insurance (compulsory* for drivers) covers.

If the driver is driving illegally without insurance, or is untraced, then the MIB steps in as pseudo-insurer.


*note for pedants - yes, yes, I know.

Do not use a No Win No Fee solicitor. Get the service of one used to dealing with cycling related incidents.
Initial use of a No Win No Fee solicitor had me doing most of the paperwork & legwork. Use of a solicitor qualified in cycle related incidents saw an immediate change in how the case was being handled. Also a more immediate response from the other side to questions raised.

The first CICA will ask for is a crime number, so if our OP doesn't have one they need to speak to T'dibble. That he has been charged is hopeful, but remember that many road traffic jobs are offences or non-compliance, and not.crimes. well worth asking the question though.

Thank you everyone, I just had this feeling that the insurance company may refuse to pay out as t was a criminal offence rather than an accident, so my mind has been put at rest by replies.
Dropping a few bits in with my solicitor tomorrow so I'll see if I can catch her and ask her view.
