Exposure light switch issues?

Bought a Maxx D Mk5 but not sure if the switch is faulty. Instead of switching light modes one at a time for each press, it will intermittently switch twice. Also, if I sometimes switch the light off and then on again the light cuts off and the only way to get it back is to plug in the charger which 'resets' it? Maybe some protection circuity is getting tripped?

Any one else had these issues? Just curious before I warranty it.
