Add the word "apparent" which is what I said. That gives you everything needed in those 3 words.

Can you stop being evasive and explain how a driver can pull out and hit someone without checking, and for them to have done nothing wrong?

i think he basically means no proof. Cyclist words against drivers. I personally wouldn't report coz nothing will be done. If she refuses to pay just end the conversation, saying you will report to police and then claim on her insurance as you have it all on helmet cam. She won't want the hassle, she will pay up.

In law, there is no such thing as 'filtering', it is simply overtaking. Overtaking is legal (subject to the restrictions like solid white lines, etc) whatever vehicle you are in/on, but rule 167 applies to all vehicles. Any rules that apply only to certain vehicle types have that clearly stated.

it applies to motorised vehicles. There is a specific instruction in the rule how to behave around cyclists.

Just to update this thread.
I received a cheque to cover all the damage in the post 2 weeks ago.

Nothing was contested and it was a very easy process from start to finish. The BC solicitors were great and most of the communication was done via email

I would be apprehensive about reporting it to the police

Firstly no one was injured so there's no duty to if you exchanged details

Secondly filtering is notoriously a grey area and can often end up as a 'knock for knock' decision so the police may inform the driver of this and she may decide she'll pay you nothing!

He says he has already received the cheque :smile: It'll be her insurance company who pay the solicitors who pay the cyclist in such a case.
