Mine was ee and it seems they can do it. So maybe I will accept it after all, if I did not read the terms properly then I mayo blame. Still something learned.

the 'new' phone was previously on Vodafone, but I want to switch to EE as that's what my old phone uses. The SIM cards are a different size too

if the new phone is locked to vodafone then your best option is to buy a vodafone sim card, or have the new phone unlocked, if you buy a vodafone sim but want to keep your number you need to ring EE and ask them for a PAC code, ring vodafone with this number and you will keep your number....

Put a different providers sim in it and see if it works, if not it is locked.
