Not sure about the second point my daughter entered a competition on itv on the breakfast show. In the t&c's it entitled them to send her a "selected promotional text" every Friday at £2.50 a pop so £10 a month. She never received any texts but the amount was added to her bill every week. She had to send a free NO to the original text she received to opt out but that bit was hidden on page 1947 of the t&c's the crafty buggers. She went into EE to say she hadn't been receiving these weekly texts and they were very uninterested tbh.

I can only go by the OPs description of events, where he makes no mention of having knowledge of the organisation. If he has done as your daughter did then that would indeed be different.

I seem to recall seeing a text from them many months ago........I "think" I just ignored it but since then they have obviously gone to my (unknown) spam folder.

You can try what I did. That being to contact the CEO of Orange(global, not the UK) and two & half years ago, Olaf of EE. Both on their home numbers.
Do you get VM through email?, has he hacked your email account?.

Could have intercepted one of your bank statements as I'm sure one of the questions is how much was your last bill?.

Not good, they should have the phone call recorded so worth asking to listen to it.
Bank statements won't give mobile numbers though. And if the call centre has buggered up, you'd be suprised at just how quick any recording may disappear.

Scam 'two' with advice needed.
This week-end I found out Virgin were charging me £30 per month EXTRA on my mobile.
Now I am a complete technophobe..............I did not know my texts had a "spam box"
Each week I have had had texts from 60077 (prizeHook.com) and they have gone to my text/spam (which I didn't know I had).
I have been charged £4.50 for each text received EVEN THOUGH I HAVEN'T OPENED THEM.
Virgin are telling me it is legal and showed me how to stop them.......done now.
Anyone know if this IS legal?
Can I claim against anyone ?

There is a regulator that's supposed to deal with these sort of reverse charge texts, payphoneplus. The first thing you should do is contact them for advice (phone number in the link). One thing I'd ask them about is dispute resolution. Normally, if a dispute between customer and telecoms company can't be resolved to your satisfaction, you can get (insist on!) a letter of deadlock which you can take to the ombudsman for independent adjudication.

You need to follow the advice that you get from payphoneplus (yes, it is a silly name, isn't it?). You'll probably have to submit a formal dispute over those text charges to Virgin, in writing. If you do, make sure you state that you expect to hear from them within a reasonable time (10 working days is probably okay) and if you don't, you'll consider the matter to be in deadlock and will take it further to the ombudsman. That ought to get things moving - complaints that go to the ombudsman are monitored by the regulators, and, even better, every one is charged to the company (Virgin, not you!), so they tend not to be too keen for things to get that far.

@Dave7 if it helps i had similar to scam about a year ago , someone was texting me once a week and it was costing £4 i think to receive these unrequired texts , when i contacted Virgin they also told me how to stop them which i duly did with there help .
 
From memory nothing more simple than texting "stop" , i dont think you can block it as it didnt show a number
So you have to be in receipt of one of the texts in the first place ? And presumably incur the charge for at least the first one before you can stop them ? You can't take preemptive action to block their receipt, eg. of any text that incurs a charge ?
 
Sounds like a great business opportunity, get hold of a load of random mobile numbers, send texts to them at £5 a time, even if every recipient is sufficiently aware to block you after the first one you still make £5k out of each 1000 numbers. Better than that, charge £50 a time and set a send frequency of once a second, that way you will have sent them hundreds before they can block you.
Is it really that simple ?
