Nope not misheard or misread we were informed by email.

I did ask for 6 months hence IPCC intervention.

Obviously this is grey area as I thought.

If he had an 'official police caution' - he will have to go to a station; admit guilt, have his fingerprints, & DNA taken (useful if has done previous or commits any future offences) , warned about future behaviour, he will then have a 'criminal record' & he may have to disclose if needed

hopefully it was the above & not just a serious 'chat' worth finding out

I've just found out that the police officer lied in his email and that he'd not been charged at all, why he said this I do not know. Anyway it's finally going to the professional standards committee so hopefully we can get the bottom of this.

I might have missed something; isn't a police caution given by the custody sergeant?
I agree that CPS wouldn't normally have anything to do with deciding to prosecute with lower level offences (as opposed to murders, rapes etc) But if you've been told he was charged that seems an odd course of action.
Was the email from a PC? Under the Victim's Code you should be informed within two days I think of any action in your case, ie offender being arrested, bailed, charged etc
Practically the only time a gaffer leaves the nick to talk to someone is if there has been a complaint about an officer! So perhaps matey boy complained and the inspector has informally resolved the matter. Nevertheless you should have been kept abreast about this.

I hope it wasn't a malicious lie, perhaps he thought the man was going to be charged and supervisors decided it wasn't in public interest, insufficient evidence etc. This can happen, where you make a decision and someone overturns it.

Are you in Scotland? If not, I thought by PACE a custody sergeant not involved in the investigation can give a caution. That's how we roll down here anyway! ;)

I expect that bit of local policy has been crafted by the Surrey Inspectors who would rather be welded to their desks.

No, not Scotland, just to the East of @bromptonfb as far as I can determine.

Hmm. I transferred from West Mids and we did it there too.
Gosh WMP aren't the best examples of policing, but at least they've changed since the bad old days.
