Have you asked for a specific amount? I think coming up with an exact number and asking for it would be good, if you haven't already. The letter on the Which? site seems a good start


It's also worrying that the CAA says

Seems to indicate that it's likely the airline with try to fark with you, and there's not much you can do about it.
What the CAA say is from the amended version of the Montreal Agreement, given earlier.
The airlines work to the same amendment.

The letter from Jet 2 said if I remain unhappy, I contact the Civil Aviation Authority or claim off my travel insurance. I shouldn't need to, it was their fault. I won't let this go, NO WAY!
Write back rejecting their offer outright.
You might also provide a summary of charges you will apply to your claim should you go to court.
These could include things like
£20 per letter sent
£10 > £15 per hour of lost free/leisure time.
Phone charges.

Then an undetermined sum to be applied to your claim for stress & inconvenience caused etc, plus your solicitors fees etc.

It might be enough for them to take you seriously, might not.

Hope you get a satisfactory result in the end.

Mrs Wife hired a BIKEBOX ALAN For a trip to South Africa earlier this year ( Tour of Cape Town / Cape Argus Bike ride) and handling staff managed to punch a hole through the middle of the box. There is a metal pole inside to stop the centre of the box collapsing in, and they somehow managed to get the pole to punch a hole right through it. This was on the trip out, the bike was not damaged at all, as soon as we arrived in SA we contacted the airline and put a claim on-line and sent them photos of the damage and a report.

For the home trip we bodged a repair with gaffa tape and a jam jar lid and got her bike back safely. The Airline sent a courier to collect the box for inspection and repair, in the end they sent a cheque for the full amount, which we sent to the hire company.

They also sent the original box back, which we repaired ourselves and the hire company have given us a free hire of another box if we want it.

Having typed this out, I'm not sure what my point is, but having typed it I'm leaving it here. I guess the point is that we followed the procedures that the airline gave us to make a claim, and they acted promptly, efficiently and fairly.

Consequential losses
Airlines do not automatically consider themselves liable for the losses you incur following on from your bag being delayed unless forced to do so by a court. For example, if you miss the start of a cruise you were booked on because you had to wait 24 hours for your bag to arrive at the airport, this will not routinely be refunded. You would have to take legal action and ask a court to award this extra compensation if the airline refuses.

If they won't pay when you miss a cruise, I doubt they would pay the costs suggested above. It would be very easy to burn through £500 if you start to engage a solicitor.

But I know you want to fight this, so I will stop watching this thread.

They will fight any claim for damages with vengeance, as they only make about £5 per passenger profit on each flight, that means that they stand to loose about one full Boeing 757 flight sector revenue if they have to pay for your bike.

I don't think that necessarily follows. Yes, airline profit margins are tiny, and they certainly won't roll over and pay up without trying to wear you down first (hence the £20 offer). But faced with the Small Claims Court, they will certainly think twice about what it will cost them to contest your claim versus how much it is and how likely you are to win regardless.
